Mineplaza Server Store – Terms of Service
Last Updated: 1st March 2025
Welcome to the Mineplaza server store (accessible at mineplaza.fun). By accessing or making a purchase on the Mineplaza store, you agree to be bound by these Terms of Service (“Terms”). Please read these Terms carefully before using the store. If you do not agree with any part of these Terms, you must not use the store or make any purchases.
1. General Information
• Service Name: This store is operated by Mineplaza, an online Minecraft server and community. All references to “Mineplaza”, “we”, “us”, or “our” in these Terms refer to the Mineplaza server and its store.
• Website: Our official website and store domain is mineplaza.fun. All purchases for in-game items or ranks are made through this website.
• Contact & Mailing Address: You may contact us or send any official correspondence to:
Mineplaza
Suite 18, 63-65 Woodside Road
Amersham, Buckinghamshire, HP6 6AA
United Kingdom
• Not affiliated with Mojang: Mineplaza is an independent server and is not affiliated with Mojang AB, Microsoft, or any official Minecraft entity. Use of the Mineplaza server and store is subject to these Terms and not the official Minecraft Terms.
By using the Mineplaza store or server, you acknowledge that you have read these Terms, understand them, and agree to abide by them.
2. User Eligibility
Mineplaza is concerned with the safety and legal rights of its users. By using our store and services, you confirm that you meet the following age requirements:
• Minimum Age: You must be at least 13 years old to access or use the Mineplaza server and store. If you are under 13, you are not permitted to use our services.
• Users Under 18: If you are between 13 and 17 years of age (inclusive), you may use the Mineplaza store only with permission from a parent or legal guardian. By making a purchase, you confirm that you have your parent or guardian’s consent to do so.
• Users 18 and Over: If you are 18 years or older, you can freely access and make purchases on the Mineplaza store. You are fully responsible for any activity on your account.
• Account Responsibility: You agree that you will not allow anyone who does not meet the above age requirements to use your account to access the Mineplaza store. You are responsible for maintaining the confidentiality of your account credentials and for all purchases made on your account.
By proceeding to use our store, you represent and warrant that you meet the applicable age requirements and (if under 18) have the necessary parental/guardian consent. Mineplaza reserves the right to request proof of age or parental consent and to terminate or restrict accounts that do not comply with these age requirements.
3. Payments & Transactions
All purchases made on the Mineplaza store are subject to the following payment and transaction terms. Please review these terms carefully before making any payment, as they affect your rights regarding refunds and disputes:
• Payment Processor: All payments are processed exclusively through PayPal. By completing a purchase, you agree to comply with PayPal’s terms of service in addition to ours. We do not accept any other payment methods (such as credit cards outside of PayPal, bank transfers, etc.) at this time.
• Digital Goods: You understand that all products for sale on Mineplaza’s store are digital goods (for example, in-game ranks, items, or perks). There are no physical products. Upon successful payment, the digital goods are delivered automatically in-game to your account (usually within a few minutes). Delivery is typically accomplished by our server applying the purchased item to your Minecraft account.
• No Shipping or Handling: Since products are digital and delivered electronically within the game, there are no shipping charges, and you will not receive any physical merchandise.
• All Sales Final – No Refunds: All purchases are final and non-refundable. By purchasing a digital good from Mineplaza, you waive any right to cancel or obtain a refund. Because our digital products are delivered immediately and provide instant access to content, you do not have a cooling-off period or right of withdrawal once delivery has started. This policy is in accordance with UK consumer law exceptions for digital content: when you consent to immediate delivery of digital items, you lose the statutory right to cancel the purchase. Please be sure you want to complete a transaction before paying, as you will not be reimbursed.
• Chargebacks and Payment Disputes: Initiating a chargeback or filing an unjustified payment dispute for a Mineplaza purchase is considered a violation of these Terms. If you attempt to reverse a valid charge (for example, by opening a PayPal dispute or chargeback with your bank after receiving your digital goods), Mineplaza will take the following actions:
• Your access to the Mineplaza server will be permanently removed. This is a zero-tolerance policy: any chargeback, regardless of reason, results in a permanent ban from all Mineplaza services.
• We reserve the right to contest the chargeback with documentation of your purchase and delivery of the digital goods. We may provide PayPal or your financial institution with evidence, including logs or records, showing that the in-game items were delivered to you.
• No Future Access: If you are banned for a chargeback, you forfeit any past or future access to items, ranks, or the server itself. We also reserve the right to refuse any future business from users who have initiated chargebacks in the past.
• Fraud Prevention: For security, Mineplaza may delay or refuse a transaction if fraud is suspected. If an issue is detected with your payment (for example, use of an unauthorized PayPal account or flagged transaction), we may halt delivery until the issue is resolved. We will attempt to contact you via the email associated with your PayPal or account in such cases.
• Currency: All prices on the Mineplaza store are listed in [Specify Currency, e.g., USD/GBP]. You are responsible for any currency conversion fees or PayPal fees that may apply. The final charge to your payment method may vary slightly due to exchange rates if you are purchasing from a country with a different currency.
• Taxes: Any applicable taxes (such as VAT for UK customers) are included in the price unless stated otherwise. If taxes are separately calculated, the store will display them at checkout. You are responsible for compliance with any local tax laws applicable to your purchase.
By completing a payment on mineplaza.fun, you acknowledge that you are authorized to use the PayPal account for the transaction, that you are purchasing a digital, non-tangible item, and that you agree to the no-refund policy and chargeback ban policy described above.
4. Governing Law & Disputes
This section explains which laws apply to these Terms and how disputes will be handled:
• Governing Law: These Terms of Service and any disputes or claims arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. We choose English law because Mineplaza operates from the United Kingdom. If you live in another country, you understand and agree that the laws of your country do not apply to these Terms (to the extent permissible under your local consumer laws), and that English law will govern.
• Jurisdiction: You agree that any dispute, claim, or controversy between you and Mineplaza that arises out of or relates to your use of the store or these Terms will be resolved exclusively in the courts of England and Wales. You consent to the personal jurisdiction of these courts. This means if you want to bring a legal claim against Mineplaza, you must do so within the court system in England or Wales, under English law.
• Attempt at Informal Resolution: Before taking formal legal action, we encourage you to contact us to discuss the issue and seek an informal resolution. Often issues can be resolved quickly by our support team. Reaching out via our support email or Discord for dispute resolution is not mandatory, but we recommend it as a first step.
• Legal Fees: In any litigation arising from these Terms, each party will be responsible for its own legal fees and costs, except as otherwise provided by law. (For example, if applicable law provides that the prevailing party is entitled to have their costs reimbursed, that law will apply.)
• Time Limit on Claims: To the extent permitted by law, any claim or cause of action you have against Mineplaza arising from these Terms or the use of the store must be brought within one (1) year from the date the claim first arose, otherwise such claim or cause of action is permanently barred. (This does not apply to consumers in jurisdictions where such time limits are not enforceable.)
By using the Mineplaza store, you agree to this choice of law and jurisdiction. We highlight that you are giving up any rights to litigate claims in any other court or under any other law except those of England and Wales (except where you have mandatory rights under local law that cannot be waived).
5. Limitation of Liability
This section limits Mineplaza’s responsibilities and liabilities to you. In summary, using our server and store is at your own risk. While we strive to provide a great service, there are things that can go wrong, and we generally will not be liable for those problems. Please read this section carefully:
• Service Provided “As Is”: Mineplaza’s Minecraft server and online store are provided on an “as is” and “as available” basis. We make no warranties or representations of any kind, express or implied, about the uptime, availability, or error-free nature of the server or store. We do not guarantee that the server will be online 100% of the time or that the store will always be accessible.
• No Liability for Downtime or Errors: Mineplaza is not responsible for any losses or damages that may result from server downtime, technical issues, data loss, lag, software bugs, or any other operational problem. This includes loss of in-game progress, loss of digital items, or missed opportunities to use purchased goods due to server outages or resets. We will try to resolve technical issues promptly, but we are not liable for consequences of such issues.
• Digital Purchases at Your Own Risk: When you purchase and use digital goods (such as ranks or items) on Mineplaza, you assume all risks associated with those items and in-game interactions. This means:
• We are not liable for in-game actions by other players or third parties that might affect your use of purchased items (for example, if another player causes your character to lose an item, or if an update/reset to the game changes how your purchased item works).
• We cannot guarantee that a particular digital item will always be available or functional in the game. For instance, if game updates or changes require adjustments to purchased items, we will attempt to provide a substitute or solution, but no refunds or guarantees are offered for changes in game mechanics outside our control.
• Indirect Damages: To the fullest extent allowed by law, Mineplaza and its owners, staff, and affiliates will not be liable to you for any indirect, incidental, special, consequential, or punitive damages. This includes, for example, any loss of revenue, loss of profits, loss of data, or loss of reputation arising from your use of the server or store, even if we have been advised of the possibility of such damages. Our total liability to you—for any claim arising out of or relating to these Terms or the Mineplaza services—will not exceed the total amount you have paid to Mineplaza in the past 12 months(or, if greater, £50 GBP as a nominal maximum).
• No Liability for External Services: Mineplaza relies on certain third-party services (for example, PayPal for payment processing, Minecraft (Mojang/Microsoft) for the base game, Discord for communications, etc.). We do not control these services and are not responsible for failures on their part. For example, if PayPal has an outage that affects payments, or if Minecraft’s authentication servers are down preventing you from logging in, those issues are outside of Mineplaza’s control and responsibility.
• Your Legal Rights: Nothing in this Limitation of Liability section is intended to limit or exclude any legal rights you have under law that cannot be legally limited or excluded. For example, we are not trying to exclude liability for death or personal injury caused by our negligence, or fraud, or any other liability that cannot be limited by law. However, for aspects that can be limited (like losses related to digital content and service downtime), this section will apply.
• Assumption of Risk: By using the Mineplaza server and purchasing digital goods, you acknowledge and accept the inherent risks of using online services and digital products. This includes the possibility of software errors, data loss, character or item loss in-game, and any other unpredictable issues. You agree that you are personally responsible for the consequences of these risks.
In summary, we will do our best to keep Mineplaza running smoothly and securely, but we cannot accept liability for things outside of our control or for certain types of losses. Use our services with caution and please follow all game and server rules to minimize risks.
6. Modifications to Terms
Mineplaza may update or change these Terms of Service from time to time. This section explains how those changes will be made and communicated:
• Right to Modify: We reserve the right to modify or update these Terms at any time at our sole discretion. Reasons for updates may include changes in the law, additions of new features to the store or server, changes in our business practices, or to clarify existing terms.
• Notification of Changes: If we make material changes to the Terms, we will inform users by posting an announcement on our Discord server and updating the Terms on the Mineplaza website (mineplaza.fun). For significant changes, we may also provide additional notice (such as a prominent notice on the store page or an email notification if we have your email on file).
• Continued Use as Acceptance: By continuing to use the Mineplaza store or server after updates to the Terms are posted, you agree to be bound by the revised Terms. If you do not agree with a change, you must stop using the store and server and, if applicable, may contact us regarding any concerns.
• Reviewing the Terms: We encourage you to periodically review these Terms so you are aware of the most current rights and obligations that apply to you. The “Last Updated” date at the top will indicate when the latest changes were made.
• Immediate Effect: Unless stated otherwise, modifications to these Terms are effective immediately when posted. Some updates might have a stated effective date in the future; if so, we will clearly communicate when the new Terms take effect.
• Archive of Terms: For your reference, we may keep an archive of old versions of the Terms accessible (e.g., via our website). If you have a question about a prior version of the Terms that was in effect on the date of your purchase, please contact us.
Mineplaza is committed to transparency with our community. If you have questions or concerns about any changes to these Terms, please reach out to us through our official communication channels (website contact form or Discord).
7. Compliance & Legal References
Mineplaza strives to ensure that our Terms of Service and business practices are compliant with all relevant laws and regulations, particularly those in the United Kingdom. This section provides references to key legal frameworks and explains how they relate to our services:
• Consumer Rights Act 2015 (UK): The Consumer Rights Act 2015 is the primary law in the UK governing consumer purchases, including digital content. Under this Act, digital products (like the in-game items and ranks we sell) must be of satisfactory quality, fit for purpose, and as described. We are committed to upholding these standards. If a purchased digital item from Mineplaza is faulty or not provided as described, you have the right to have the issue corrected. (For example, if you purchase a rank and do not receive it, contact us and we will ensure you get what you paid for.) However, as noted in our Payments & Transactions section, the Consumer Rights Act 2015 does not provide an automatic right to a refund for digital content that is delivered and not faulty. Our no-refund policy is aligned with this law, as digital content is generally non-refundable once accessed, except in cases of defect or our failure to deliver.
• Digital Content Directive (EU Directive 2019/770): The Digital Content Directive is a European Union directive that addresses the supply of digital content and digital services. While the UK’s obligations under this directive may have changed due to Brexit, Mineplaza voluntarily aims to meet a high standard of consumer protection. This directive emphasizes that digital goods should function as advertised and that consumers should have remedies if they don’t. We take these principles seriously. In the spirit of the directive, if you encounter issues with our digital products, we will work with you in good faith to resolve them, whether through a fix, replacement, or other remedy as appropriate.
• No-Cancellation Exception for Digital Downloads: Under UK consumer protection regulations (such as the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, which implemented the EU Consumer Rights Directive), there is an exception to the 14-day “cooling-off” cancellation period for digital content. This exception applies when digital content is provided immediately to the consumer and the consumer has acknowledged they lose their right to cancel once the download or access begins. By purchasing from Mineplaza, you acknowledge and agree that your digital content (game perks/items) will be provided immediately and that you lose any right to cancel the purchase from the moment delivery begins. This is why we require you to agree to these Terms (including the no-refund policy) at checkout.
• Chargeback Rules: We reference applicable chargeback rules to emphasize that unwarranted chargebacks are not a legitimate means of obtaining a refund. Credit card networks and PayPal have rules in place to protect merchants from fraudulent chargebacks. For example, initiating a chargeback for an item that was delivered as described can be considered fraudulent. Our policy of permanently banning users who chargeback is in line with these protections. We maintain detailed logs of transactions and delivery confirmations to contest any chargeback. Keep in mind that misuse of chargebacks might also violate your agreement with PayPal or your bank, potentially leading to further consequences on your end.
• Compliance with Other Laws: Mineplaza complies with other relevant laws and regulations, such as data protection laws (e.g., GDPR for EU/UK user data privacy) and online safety regulations. Please refer to our Privacy Policy for details on how we handle personal data. We also comply with Mojang’s Minecraft EULA and guidelines for servers, ensuring that our store offerings (like ranks or cosmetics) are permitted under those rules.
• No Waiver of Statutory Rights: Nothing in these Terms is intended to unlawfully restrict your statutory rights. UK consumer law provides certain inalienable rights to consumers, and while we emphasize no refunds and limited liability, those apply only to the extent permitted by law. For instance, if a law provides you a non-excludable right or remedy, these Terms do not override that. Any provision of these Terms found to be unenforceable under applicable law shall be severed (removed) or interpreted to the maximum extent permissible, and the remaining provisions will continue in full force.
By providing these legal references, we aim to be transparent about our obligations and your rights as a consumer. If you have any questions about how these laws apply to your interactions with Mineplaza, feel free to contact us for clarification.
8. Other Provisions
To ensure this Terms of Service is comprehensive and clear, here are some additional general provisions common to agreements of this nature:
• Acceptance of Terms: By using the Mineplaza website or server, or by purchasing any product from our store, you acknowledge that you have read, understood, and agree to these Terms of Service in their entirety.
• Severability: If any provision (or part of a provision) of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be deemed severable from the Terms and will not affect the validity and enforceability of the remaining provisions. The rest of the Terms will remain in full effect.
• Waiver: If Mineplaza does not enforce a provision of these Terms in some instance, this does not mean we are waiving our right to enforce it in the future. Any waiver of rights by Mineplaza must be made in writing to be effective. Similarly, you cannot waive any rights under these Terms unless done so in writing.
• Entire Agreement: These Terms (along with any additional policies referenced, such as our Privacy Policy) constitute the entire agreement between you and Mineplaza regarding the store purchases and use of our services. It supersedes any prior or contemporaneous understandings, agreements, or communications (whether oral or written) regarding the same subject matter.
• Transfer of Rights: You may not transfer or assign any of your rights or obligations under these Terms to any other person without our prior written consent. Mineplaza may transfer or assign its rights and obligations to another party (for example, if the server ownership changes or in a corporate reorganization), but if we do so, we will ensure that your rights under these Terms are not reduced.
• Headings: The section titles (headings) in these Terms are for convenience only and have no legal effect. They do not affect the interpretation of the provisions.
• Language: These Terms are drafted in English. If you are reading a translation and there is any conflict with the English version, the English version will prevail.
